Terms and conditions
Ordering products and using the functionalities of our website implies the acceptance of the general terms and conditions mentioned below.
The prices are those indicated at the time of the order.
Prices are quoted in Swiss francs or euros. They represent net amounts, including VAT and are subject to price adjustments by suppliers and/or significant exchange rate fluctuations.
The images illustrating the products are not contractual.
If a product is unavailable, we will inform you as soon as possible and offer you either a refund or a credit for a new purchase.
TERMS OF PAYMENT
Payment is made online by credit card via the platform Stripe. Banyan Alliance SA is not responsible for any technical failures related to this payment tool.
Any goods ordered will be delivered after receiving the payment.
DELIVERY AND TRANSPORT
Shipping costs for Switzerland, for up to 3 chocolate bars, are CHF 6 (by priority mail). For parcels of up to 2 kg, the shipping costs are CHF 10 by standard mail and CHF 12 by priority mail. For a purchase of CHF 89 or more, shipping costs are free of charge.
Shipping costs for France, for up to 3 chocolate bars, are CHF 11 by standard mail and CHF 15 by priority mail. For parcels of up to 2 kg, the shipping costs are CHF 26 by standard mail and CHF 33 by priority mail. For any order over 2 kg, the customer is required to ask Banyan Alliance SA for a quotation.
Shipping costs for other countries of the European Union, up to 3 chocolate bars, are CHF 11 by standard mail and CHF 15 by priority mail. For parcels of up to 2 kg, these are CHF 37 by standard mail and CHF 41 by priority mail. For any order over 2 kg, the customer is required to ask Banyan Alliance SA for a quotation.
The preparation of the order is carried out within a maximum of 5 working days.
For orders outside of Switzerland, Banyan Alliance SA does not take charge of possible customs charges, nor is it responsible for the legal restrictions specific to each country concerning certain specific products. Please make sure to inquire beforehand.
Despite all the care we put in packaging our chocolate bars, Banyan Alliance SA is not responsible for any damage due to transport conditions. Please let us know of any problems so that we can improve our collaboration with the carriers.
Delivery times are given for information only. Banyan Alliance SA cannot be held responsible for delays in deliveries in the case of force majeure, transport problems, customs retentions or any other reason beyond its control. If the goods can nevertheless be delivered, the contract will be maintained without any compensation being due to the customer.
In the event of impossibility of delivery caused by the customer (incorrect indication of address or other data), Banyan Alliance SA shall not be held liable under any circumstances.
IMPORTANT: No delivery can be made to a post office box and no shipment is made during periods of high heat to avoid deterioration of the products during transport.
RETURN, EXCHANGE AND CONTROL OF GOODS
Goods are neither taken back nor exchanged.
The customer commits to inspecting the goods immediately upon receipt. Any complaint must be communicated immediately to Banyan Alliance SA, otherwise the delivery will be considered as accepted and without defect.
USE AND PROTECTION OF PERSONAL DATA
All personal data will be treated as confidential. The information necessary for the management of the order will be subject to computer processing and may be communicated to associated companies as part of the management of the order.
Unless a customer account is created, personal data will be deleted after the order has been processed and within the legal deadlines.
The electronic contact details provided as part of a customer account may be used to send you information about our chocolate products and events.

PLACE OF JURISDICTION AND APPLICABLE LAW
All questions relating to the interpretation or execution of these general terms and conditions are the responsibility of the ordinary courts of the Republic and Canton of Geneva. Recourse to the Swiss Federal Court is reserved. The general terms and conditions are subject to Swiss law, excluding conflict-of-law rules and the Vienna Convention (CISG).
